Sub: Establishment of CONTAINER FREIGHT STATION inside MEPZ-SEZ-Procedure to be
followed – Reg.

As per the Central Board of Excise & Customs letter F.No.305/38/2001-FTT dated
03.01.2003, addressed to all the Chief Commissioners/Commissioners of
Customs/Commissioner of Central Excise and Customs, ”an identified area within
the Special Economic Zone (SEZ) would be notified as an ICD or CFS, as the case
may be”.
2. The Development Commissioner, Madras Export Processing Zone (MEPZ) vide
letter F.No. 8/426/2003/SEZ dated 24.04.2003, informed that MEPZ-SEZ,
(hereinafter referred to as the Zone) had identified an area of 10862.49 sqm. in
survey no.135/2 in Kadapperi Village, Tambaram, Kancheepuram District within the
Zone for the proposed CFS and had nominated Container Corporation of India Ltd.,
(CONCOR) as the Custodian of the proposed CFS. On the basis of the application
made by “CONCOR”, Commissioner of Customs (Air) has notified them as the
Custodian of the CFS (herein after referred to as the custodian SEZ) vide Public
Notice No. 133/2003 (AIR) Dated 27.08.2003.
IMPORT (FCL):
3. The newly notified CFS in the Zone will be treated as a regular Customs
station in terms of section 54(3)(b) of the Customs Act 1962 and all the import
cargo intended for units situated inside the Zone arriving at Chennai Port / Air
Cargo / other CFS will be permitted to be transshipped directly to the CFS in
the Zone as in the case of transhipment of FCL/LCL cargo to hinterland ICDs from
the port/Airport/CFS. The custodian SEZ will complete all the transshipment
formalities at the Port/Airport/other CFS and move FCL/LCL cargo into the zone.
For this purpose, the Custodian SEZ will obtain a one time authorization from
the units in the Zone authorizing the Custodian SEZ to transship all their FCL/LCL
Cargo from Port/Air Port/other CFS and these authorization shall be filed with
the Superintendent (Transhipment) of the Port/Air Port/other CFS, as the case
may be.
4. Superintendent (Transshipment), Air Cargo Complex will allow the
transshipment as per the procedure in force and hand over the transporters the
transport documents. The transporters shall be those authorised by the Custodian
SEZ who will be responsible for the safe movement of the goods to the Zone and
on arrival at the Zone, hand over the transport document to the Customs gate at
the Zone.
5. Before the goods come to the zone, the assessed unnoted Bills of Entry will
be presented by the CHA Unit to the P.O. at the Zone Customs gate. On arrival of
the import container as indicated at para 4, the P.O. will verify the marks and
number on the containers/cargo and make a record of the same on the duplicate
copy of the Bill of Entry and hand over to the Custodian, SEZ then endorse Bill
of Entry for further delivery of the goods to the respective importers inside
the Zone. Thereafter, the unnoted Bills of Entry will be taken by the Custodian
SEZ for noting at the Port/Air Cargo Complex. The original Bill of Entry will be
detached at the respective import departments. The custodian SEZ will handover
the duplicate Bills of Entry to the Customs at MEPZ and the remaining copies of
the Bills of Entry to the CHA unit under acknowledgement. The custodian SEZ
shall deliver the noted Bills of Entry in the above manner every fortnight.
6. The Custodian SEZ should maintain two separate registers, one for the
incoming and the other for the outgoing export containers/ cargo. The register
should contain all the particulars such as IGM/EGM number, Line No., Bill of
Entry/Shipping Bill No., Container No., Seal No., TSA/Gate pass No., description
of the Cargo, name of the importer/exporter, name of the CHA, destination,
inward/outward time & date etc., and these registers should be available in the
CFS for examination by the Customs at any point of time.
IMPORT (LCL):
7. The procedure for transshipment of LCL Cargo from the Airport/Seaport/other
CFS will be almost identical except for the fact that the transhipment
application copy duly approved by the Superintendent (transshipment) will be
produced to the P.O. incharge of transhippment(Air), Bharthi Docks (LCL) or the
CFS concerned, where the container is destuffed. The LCL cargo will be taken
delivery from the respective custodians by the CFS custodian, SEZ in a closed
truck. More than one LCL transshipment cargo meant for Zone units could be
transshipped in the same truck. After loading the cargo, the truck will be
sealed by the Customs officer with the one time Customs seal and he will
indicate the particulars of the seal affixed in the TSA copy.
In case LCL cargo are to be collected from more than one Customs Stations, the
seal affixed by the first officer may be removed in the presence of P.O. in the
next Customs Station and after loading the LCL consignment in the vehicle, he
should affix another OTL on the vehicle and the details of all the seals affixed
and removed should be clearly indicated in the TSA in order to enable the P.O.
at the zone gate to correlate the same. On arrival of the cargo at the zone, the
P.O. should verify the OTL No., as mentioned in the TSA before opening the door
of the Container/Truck. Thereafter the container/truck will be handed over to
the custodian SEZ who will ensure delivery of the goods to the respective units.
EXPORT (FCL):
8. As in the case of imports, the units in the zone will give a one-time
authorization to the custodian SEZ authorizing them to handle the FCL/LCL cargo
for export. The shipping bills will be assessed by the Customs and the goods
examined and container sealed as per the procedure inforce. The shipping
documents and the assessed shipping bill will be handed over to the CHA Unit by
the Customs. Thereafter the CHA Unit holder will handover the Cargo along with
the Shipping Documents to Custodian SEZ. The custodian SEZ will see to the
movement of the container to the Port/Airport/other CFS for export. The P.O. at
the zone gate will verify the marks and numbers on the container and the seal
particulars with reference to the assessed shipping bills and also the details
mentioned in the gate pass and allow the removal of the cargo out of the zone
gate after affixing the signature on the gate pass (copy of gate pass enclosed).
The custodian SEZ will produce the copy of the gate pass where the P.O. at the
Port of Exit/Airport/Other CFS has signed, to the P.O. at the zone gate for the
closure of the export register entry.
EXPORT (LCL):
9. The Shipping Bills are assessed and the ‘Let Export Order’ is given on the
duplicate copy of the shipping bill after the packages are sealed. The sealed
packages meant for export along with shipping documents are handed over to the
CHA/Unit holder who hand over the same to the Custodian SEZ. Thereafter the
goods move out of the zone under gate pass procedure in case it is related to
one unit. In case of the multiple unit cargo, the Custodian SEZ will take
delivery of the sealed packages from the various units for movement to the port
of exit. However in case of unsealed package, the Custodian SEZ shall take over
the goods under acknowledgement on the Shipping Bill. The Custodian SEZ shall
thereafter move these or collect other such cargo in the vehicle and bring them
to the zone Customs gate where the P.O. will seal the vehicle / truck with the
seal and make necessary endorsements on the shipping documents. At the gate way
port/Airport/other CFS the documents and the seals on the packages or truck as
the case may be, are checked by the Customs. If the seals are found intact and
the documents are in order, the goods are allowed to be destuffed from the truck
and stuffed in to containers under Customs supervision. In case of export by
air, goods after destuffing from the truck are palletized and loaded into the
Aircraft under Customs supervision. The P.O. supervising the destuffing of the
goods endorses the duplicate, the triplicate copy of the shipping bills and
other shipping documents. One copy of the gate pass is retained at the exit port
/ Airport / other CFS and the copy of the shipping bill are returned to the
Custodian SEZ. The custodian SEZ shall then file necessary papers with the
Steamer Agents so that the EGMs can be filed and closed by the Customs. The
custodian SEZ will produce the copy of the Gate pass where the P.O. at the port
of Exit / Airport / Other CFS has signed to the P.O. at the Zone Gate for
closure of the Export register entry.

THE NECESSARY PROOF OF THE RECEIPT OF THE CARGO BY THE CONCERNED E.F.O. (A.C.C.)/
P.O. (HARBOUR) BEFORE 12.00 NOON OF THE NEXT WORKING DAY. WE ALSO AGREE TO PAY
THE CUSTOMS DUTY AND PENALTY THAT MAY BE LEVIABLE IN THIS CASE OF LOSS OR DAMAGE
OCCURING TO THOSE GOODS. WE ARE AWARE THAT IF THE ABOVE REQUIREMENT IS NOT
COMPLIED WITH THE UNIT LIABLE TO BE PROCEEDED AGAINST TREATING. THE REMOVAL AS
HAVING BEEN DIVERTED ELSEWHERE INSTEAD OF BEING EXPORTED.
